FENOMENA “NO VIRAL NO JUSTICE” DALAM PENEGAKAN HUKUM DAN KEADILAN DI INDONESIA

Abstract

Fenomena “ Law Is Viral ” menggambarkan adanya pergesaran paradigma penegakan hukum diera digital. Viralitas di media social kerap menjadi factor penentu dalam mendorong respon aparat penegak hukum. Penelitian ini menkaji peran viralitas media social dalam membentuk akses public terhadap keadilan di Indonesia yang dikenal dengan ‘Tak Viral, Tak Ada Keadilan’. Dengan menggunakan pendekatan sosiolegal, penelitaan ini menganalisis dinamika anatata tekan public digital dan respon aparat penegak hukum dalam sejumlah kasus yang menjadi viral. Hasil penelitian menunjukan bahwa viralitas dapat mempercepat respon Negara dalam menangani suatu kasus dana membuka ruang bagi partisipati publik. Namun, fenomena ini juga berpotensi merusak prinsip – prinsip dasar dalam sistem peradilan, khususnya prinsip due process of law, dan menimbulkan disparitas dalam penanganan kasus viral dan non – viral. Penelitian ini merekomendasikan penting merumuskan kerangka regulasi yang menyeimbangkan partisipa publik melalui media digital sebagai alat kontrol sosial dengan perlindungan integritas, idependensi, dan objektivitas sistem hukum.
